April 20, 2021. The Standing Committee on Legal Affairs of the State Great Hural discussed the Constitutional Court’s conclusion No.2 issued on April 16, 2021.
The Constitutional Court of Mongolia has rendered a conclusion that people, who were elected as President or served as President, running for another term as well as provisions 3.1.2. and 5.4. of the Law on Presidential election are in conflict with the provisions 1.2., 30.2. and 70.1 of the Constitution of Mongolia with last amendments made in 2019.
Article 3.1.2. of the law on presidential election reads as ‘presidential candidate is a person who is a citizen of Mongolia, who reached the age of 50, has a permanent residence in the country for at least the five years prior to the election and registered their candidacy for the President of Mongolia and received candidacy card.
Article 5.4. of the law also states that a citizen of Mongolia, who reached the age of 50, has a permanent residence in the country for at least the five years prior to the election and fulfills all other requirements set in the Constitution of Mongolia and this law are eligible to be elected as the President of Mongolia.
As the two provisions mentioned above contradicts the certain provisions of the Constitution, the Constitutional Court has made a decision to suspend the two provisions in the law on Presidential election. Following the discussion and debate, majority of the Committee members agreed to accept the Constitution Court’s conclusion and to introduce its decision at the plenary session.
The next issue discussed were the first hearings of the draft laws on Trademarks and Geographical Indications, Copyrights and revised draft on Patent law.
April 22, 2021. At the plenary session of the State Great Hural, the first hearings of the draft law on Trademarks and Geographical Indications, and the revised draft on Patent Law were held and agreed to transfer to affiliating Standing Committee for final hearing. Also, it has been agreed to discuss the draft law on Value Added Tax Exemption and Customs Tax Relief, and to transfer to the Standing Committee on Budget. Moreover, the State Great Hural Resolution on “Constitution Court’s conclusion No.2” was discussed and ratified. The parliament’s approval of the Constitution Court’s conclusion makes the current and former presidents of the country ineligible to run for presidency again.
April 22, 2021. Chairman of the State Great Hural (Parliament) of Mongolia G.Zandanshatar received the Ambassador Extraordinary and Plenipotentiary of the Russian Federation to Mongolia I.K.Azizov.
April 23, 2021. At the plenary session of the State Great Hural, the final hearings of the draft laws on Value Added Tax Exemption and Customs Tax Relief were reviewed and ratified.
April 23, 2021. Members of State Great Hural (Parliament) Ts.Munkh-Orgil, Ts.Munkhtsetseg, and G.Damdinnyam called a press conference regarding the Democratic Party's possible signing of a 50,000 USD contract with a US lobbying firm.
