Conference Held on Making Court Enforcement Operations More Efficient, Prompt, and Effective

Ulaanbaatar, January 16, 2025 /MONTSAME/. On January 15, 2025, the Standing Committee on Justice of the State Great Khural (Parliament) of Mongolia, in collaboration with the European Bank for Reconstruction and Development (EBRD), organized an International Theoretical and Practical Conference on “Improving the Legal Environment for the Enforcement of Civil Court Decisions.”
The Conference was opened by Member of Parliament and Head of the Standing Committee on Justice Tsogtbaatar Damdin, Member of Parliament and Minister of Justice and Internal Affairs Altangerel Oyunsaikhan, and Ambassador Extraordinary and Plenipotentiary of the European Union to Mongolia Ina Marciulionyte. MP Tsogtbaatar Damdin stated, “The Conference is being organized to explore ways and take measures to improve the legal environment for enforcement operations, making them more efficient, prompt, and effective. The enforcement of court decisions is not a separate issue from the judiciary. It is important to reflect the opinions of the judicial officers conducting these operations."
Minister of Justice and Internal Affairs Altangerel Oyunsaikhan noted, “Amendments to the Law on Enforcement of Court Decisions are planned to be discussed at the spring session of the State Great Khural. I am confident that the discussions will contribute to addressing the decline in the efficiency of enforcement actions.” Furthermore, MP Nominchimeg Odsuren highlighted, “Reforming the enforcement of court decisions is crucial for improving the business and investment environment of Mongolia and ensuring sustainable economic growth. At this Conference, we discussed the need for reform and have reached a consensus, ensuring the participation of key stakeholders, including the Mongolian Chamber of Commerce and Industry, the Banking Association, the Bar Association, the judiciary, ministries, and international organizations. The Parliament will provide policy support to accelerate these reforms and implement necessary changes promptly.”
Ambassador of the European Union to Mongolia Ina Marciulionyte emphasized, “Diversifying the economy and attracting foreign investment is one of the key objectives outlined in the Partnership Agreement between Mongolia and the European Union. This seminar aims at exchanging experiences, learning from best practices, and discussing important suggestions for reforms in the enforcement of civil and commercial court decisions, thus addressing these key objectives.”
Principal Counsel of the EBRD’s Legal Transition Team Veronica Bradautanu mentioned that the EBRD initiated a technical assistance project in Mongolia aimed at strengthening the enforcement of commercial court decisions in the Autumn of 2023. The project, funded by the European Union, focuses on supporting amendments to relevant legislation, digitizing enforcement processes, and enhancing the overall effectiveness of the legal system.
The Conference continued with a presentation by Jos Uitdehaag, First Vice President of the International Association of Judicial Officers, who shared international best practices in court enforcement. Minister Altangerel Oyunsaikhan presented the principles of legal reform in Mongolia’s enforcement system, while Z. Shagdarsuren, a legal consultant for the EBRD project, reviewed recommendations for amendments to the Law on Enforcement of Court Decisions.
The participants of the Conference discussed the need to increase the number of decision-makers and improve the knowledge and skills of judicial officers. They pointed out issues such as delays, workload, and the advantage given to debtors due to errors during enforcement proceedings. They also exchanged views on the importance of strengthening the enforcement system, the impact of legal reforms, and opportunities for international cooperation.
Furthermore, B.Nyamgombo, Deputy Head of the General Authority for Court Decision Enforcement, presented on “The Current State and Emerging Issues of Civil Enforcement.” P. Zolzaya, a judge of the Supreme Court of Mongolia, discussed the role of the judiciary in improving the enforcement of civil cases.
At the end of the Conference, MP Baasanjargal Khurelbaatar emphasized the need to reconsider the staffing and budget issues related to enforcement agents. Mrs. Baasanjargal noted that there is potential to resolve disputes more promptly and effectively, calling for attention to enforcement issues not only in the capital but also in the regions. She encouraged participants to submit their feedback and suggestions for future improvements.
